Welcome to the 818 App operated by Emerald Springs, LLC ("Company"). By accessing or using our mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, please do not use our App.

1. Acceptance of Terms

By downloading, installing, or using the 818 App, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. These Terms govern your use of the App, including features related to tracking loyalty points, viewing past orders, shopping, and messaging our support team.

2. Eligibility

To use this App, you must meet the following requirements:

• Be at least 21 years of age.
• Be a resident of California.

3. User Accounts and Registration

• Account Creation: Certain features of the App may require you to create an account. You agree to provide accurate, current, and complete information during registration.
• Account Security: You are responsible for maintaining the confidentiality of your account login credentials. Notify us immediately if you suspect any unauthorized use of your account.
• Termination: We reserve the right to suspend or terminate your account if any information provided is inaccurate or if you breach these Terms.

4. Loyalty Points Program

• Earning Points: The App tracks loyalty points earned through purchases made at our Studio City and Palm Springs locations. Points are automatically credited based on your transaction details.
• Redemption: Loyalty points can be redeemed for discounts or special rewards, as outlined within the App. At this time, loyalty points do not expire; however, the rules and terms governing the program may be modified at our discretion.
• Non-Transferability: Loyalty points are non-transferable and have no cash value.

5. Use of the App

• Permitted Use: You agree to use the App only for lawful purposes and in accordance with these Terms.
• Prohibited Conduct: You must not misuse the App by interfering with its functionality, using automated systems to access it, or engaging in any activity that could harm our services or other users.
• Third-Party Links: The App may include links to third-party websites or services. We are not responsible for the content or practices of these third parties.

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
